1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes your acceptance of the updated Terms.

2. Description of Service

MoltyClaw.ai provides managed, cloud-hosted infrastructure for running OpenClaw and related AI-powered assistant systems (the “Service”). This includes cloud-hosted instances, AI-powered features, automation capabilities, and management interfaces. We do not control and are not responsible for how individual users configure or utilize the Service.

3. Eligibility

You must be at least 18 years of age, or the minimum legal age in your jurisdiction, to use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that entity to these Terms.

4. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or use. We reserve the right to suspend or terminate accounts that are found to be in violation of these Terms.

5. Billing and Payments

Fees for the Service are charged as described during checkout. Subscriptions include a 7-day free trial and renew automatically at the end of each billing period unless canceled. Payment processing is handled by third-party providers (Stripe). All fees are non-refundable except where required by applicable law. No proration is applied when canceling mid-period; access continues until the end of the current billing cycle.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights.
• Produce, distribute, or store illegal, harmful, or abusive content.
• Interfere with, disrupt, or degrade the performance of the Service.
• Attempt unauthorized access to any systems, networks, or data.
• Distribute spam, malware, or other malicious code.
• Generate or disseminate content that infringes intellectual property rights.
• Conduct automated abuse, scraping, or denial-of-service attacks.
• Impersonate any individual or organization.
• Deploy autonomous agents that interact with third-party services without proper authorization.

We reserve the right to suspend or terminate access for any violation of this section.

7. Resource Limits

Your usage of the Service must remain within the resource limits associated with your subscription plan. We may throttle, restrict, or suspend usage if those limits are exceeded.

8. AI Features and Outputs

The Service may generate content using artificial intelligence. Such outputs may be inaccurate, incomplete, or misleading. We make no guarantees regarding the accuracy, reliability, or suitability of AI-generated content. AI outputs are provided for informational purposes only and do not constitute professional, legal, medical, financial, or any other form of advice. You are solely responsible for reviewing, verifying, and supervising any AI-generated outputs or automated agents created through the Service. We are not liable for actions taken by such agents, including unintended outputs, incorrect actions, or third-party interactions.

9. Intellectual Property

The Service and all associated content, branding, and technology are owned by MoltyClaw.ai or its licensors. You retain ownership of any content you submit. By using the Service, you grant MoltyClaw.ai a limited, non-exclusive, worldwide license to host, process, transmit, and display your content solely for the purpose of operating, maintaining, and improving the Service. You are solely responsible for the legality, reliability, and appropriateness of content you submit.

10. Copyright Policy (DMCA)

We respect intellectual property rights. If you believe material on the Service infringes your copyright, you may submit a notice containing: identification of the copyrighted work, identification of the allegedly infringing material, your contact information, and a good-faith statement that the use is unauthorized. DMCA notices should be directed to support@moltyclaw.ai. Counter-notifications may be submitted in accordance with the DMCA.

11. Third-Party Services

The Service may integrate with or rely on third-party providers, including payment processors, cloud infrastructure providers, and AI model providers. Your use of such services is governed by their respective terms and policies. We are not responsible for the availability, accuracy, or practices of any third-party service.

12. Service Availability

We do not guarantee that the Service will be available at all times without interruption or error. Periods of downtime may occur due to scheduled maintenance, system updates, or factors beyond our control.

13. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

14. Limitation of Liability

To the fullest extent permitted by law, MoltyClaw.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or revenue, arising out of your use of the Service or AI-generated outputs. Our total aggregate liability shall not exceed the greater of the amount you paid to us in the twelve (12) months preceding the claim or one hundred US dollars ($100).

15. Indemnification

You agree to indemnify, defend, and hold harmless MoltyClaw.ai and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service or your violation of these Terms.

16. Termination

We may suspend or terminate your access to the Service at any time for violations of these Terms. You may discontinue use of the Service at any time. Upon termination, we may delete or anonymize your associated data in accordance with our Privacy Policy. Your sandbox and stored agent data are removed after your subscription period ends.

17. Export Compliance

You agree to comply with all applicable export control and sanctions laws, including those of the United States. You may not use the Service if you are located in a country subject to a U.S. embargo or if you appear on any U.S. government restricted party list.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

19. Dispute Resolution

Any dispute arising out of or in connection with these Terms or the Service shall be resolved through binding arbitration conducted in Wilmington, Delaware, unless otherwise required by applicable law.

20. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or via email. The “Last updated” date at the top of this page reflects the most recent revision.
