Terms of Service

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time. Material changes are communicated by email at least 30 days before the effective date and via a dashboard banner on the effective date. Continued use after the effective date constitutes acceptance.

2. Description of Service

MoltyClaw.ai provides managed cloud-hosted infrastructure for running OpenClaw and related AI-powered assistant systems (the “Service”). The Service includes per-customer virtual private servers, optional managed AI credit budgets, automation capabilities, and management interfaces.

3. Eligibility

You must be at least 18 years of age, or the minimum legal age in your jurisdiction, to use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that entity to these Terms.

4. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or use.

5. Billing and Payments

Fees for the Service are charged monthly as described during checkout. Your subscription combines a server hosting line item with an optional AI credit line item, billed together via Stripe. All fees are non-refundable except where required by applicable law or as specifically provided in these Terms (see Cancellations and the Provisioning Guarantee). All prices are in USD.

6. MoltyClaw Managed AI

• MoltyClaw provisions and manages an AI API key on the customer's behalf via OpenRouter.
• The monthly AI budget is set according to the selected plan (Starter $10, Advanced $20, Pro $30, or Custom between $5 and $100). Budgets above $100 are available by contacting sales.
• Budget does not carry over. Unused credit from the current billing period is forfeited when the period resets. The budget resets to the plan amount at the start of each new billing period.
• Top-up credits also do not carry over. One-time top-ups purchased during a billing period are available until the end of that period and are forfeited on the next reset.
• If the AI budget is exhausted before the end of the billing period, the AI agent will stop responding to prompts until you either purchase additional credits (one-time top-up) or the next billing period begins.
• Customers may upgrade their AI plan or purchase one-time credit top-ups at any time via the dashboard. Upgrades take effect immediately (prorated); downgrades take effect at the next billing period boundary.
• MoltyClaw reserves the right to change AI credit pricing with 30 days' notice. Existing subscriptions are honored until the end of their current billing period.

7. Cancellations and Refunds

• Cancellations take effect at the end of the current billing period. When you cancel, your agent continues to run until the period ends, at which point your VPS is destroyed and no further charges apply.
• No prorated refunds are issued for cancellations mid-period.
• If you require immediate destruction of your instance (e.g. for security reasons), contact support at contact@moltyclaw.ai and we will assist.
• Provisioning guarantee: if MoltyClaw cannot successfully provision your instance within 24 hours of payment, you are entitled to a full refund upon request.

8. Service Interruptions and Payment Failures

• If a renewal payment fails, MoltyClaw will retry the charge according to standard Stripe retry behavior (approximately 21 days).
• During this retry period, your agent will be paused (container stopped) to avoid further service usage on an unpaid account. You can update your payment method via the “Manage billing” link in your dashboard; the agent resumes automatically once payment succeeds.
• If no successful retry occurs within the retry period, your subscription is canceled and your instance is destroyed.

9. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights.
• Produce, distribute, or store illegal, harmful, or abusive content.
• Interfere with, disrupt, or degrade the performance of the Service.
• Attempt unauthorized access to any systems, networks, or data.
• Distribute spam, malware, or other malicious code.
• Conduct automated abuse, scraping, or denial-of-service attacks.
• Impersonate any individual or organization.

10. AI Features and Outputs

The Service may generate content using artificial intelligence. Such outputs may be inaccurate, incomplete, or misleading. We make no guarantees regarding accuracy, reliability, or suitability of AI-generated content. AI outputs are provided for informational purposes only and do not constitute professional, legal, medical, financial, or any other form of advice. You are solely responsible for reviewing, verifying, and supervising any AI-generated outputs or automated agents created through the Service.

11. Intellectual Property

The Service and all associated content, branding, and technology are owned by MoltyClaw.ai or its licensors. You retain ownership of any content you submit. By using the Service, you grant MoltyClaw.ai a limited, non-exclusive, worldwide license to host, process, transmit, and display your content solely for the purpose of operating, maintaining, and improving the Service.

12. Third-Party Services

The Service may integrate with or rely on third-party providers, including payment processors, cloud infrastructure providers, and AI model providers. Your use of such services is governed by their respective terms and policies.

13. Service Availability

We do not guarantee that the Service will be available at all times without interruption or error. Periods of downtime may occur due to scheduled maintenance, system updates, or factors beyond our control.

14. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

15. Limitation of Liability

To the fullest extent permitted by law, MoltyClaw.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or revenue, arising out of your use of the Service or AI-generated outputs. Our total aggregate liability shall not exceed the greater of the amount you paid to us in the twelve (12) months preceding the claim or one hundred US dollars ($100).

16. Indemnification

You agree to indemnify, defend, and hold harmless MoltyClaw.ai and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service or your violation of these Terms.

17. Termination

We may suspend or terminate your access to the Service at any time for violations of these Terms. You may discontinue use of the Service at any time. Upon termination, your VPS and stored agent data are removed after your subscription period ends.

18. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute shall be resolved through binding arbitration conducted in Wilmington, Delaware, unless otherwise required by applicable law.

19. Changes to These Terms

These Terms are versioned (current version: 1.0.0). Material changes (new service categories, changes to refund policy, pricing changes) are communicated to customers via email at least 30 days before the effective date and via a dashboard banner on the effective date. A dashboard modal may prompt for explicit re-acceptance on material changes; your acceptance is recorded (with IP address and user agent) in our acceptance ledger.
